Coverage for hole-in-one, half-court shots, match the key, six inches of snow on the 25th of December all can be provided to indemnify the sponsor or promoter for the amount of cash or prizes specially named in the rules. RULES--this is the key to prize indemnity: read the rules.
Several years ago the Chicago Bulls and Coke sponsored a half-court shot in which the rules that the participants signed asked, "Have you played college or professional basketball?" The rules did not exclude only players who had been on the starting five of a college team or in the Final Four. The person who made the half-court shot had played for a short time on a college team, so the insurer declined to pay, creating a controversial initial denial of the prize. (Eventually payment was made because of the public relations problems that followed the denial.)
Because each promotion is different and there really are no two alike, it is imperative that close attention be paid to understanding what restrictions are placed on the sponsor and the entrants. All parties must know how you can win and how you can be disqualified. The sponsor wants to award the prize because it has paid the premium, reaped the publicity, and doesn't want to look bad by invoking some "silly rule."
If an organization wishes to protect against a rainout of its annual street fair, it should be aware of two things: where the rainfall is measured and who is responsible for paying the observer. Most official rainfall will be measured at the weather bureau, which is probably at the local airport. Now--how close is your airport to the location of the event? It could be 10 miles or even 30 miles away, and if no rain falls at this site, no loss will occur. In order to gauge the rainfall at the event, the client can retain and pay an observer. This is to the client's advantage because it will eliminate future problems in regard to payment of a claim. The measurement of rain at the festival, not at the airport, will determine whether or not there is monetary loss.
Now that caution is in place, let's look at the opportunities. "Prize indemnity coverage is a very specialized product that requires underwriting expertise," says Cindy Broschart, vice president of Gulf Insurance Group's entertainment division. "At the same time, the market for these coverages continues to grow at a very rapid pace, signaling an exciting era of opportunity for experienced, proven underwriters."
The range of events that can be prospects, not only for prize indemnity but for general liability, liquor liability, inland marine, auto, D&O, and fireworks, is vast. It also grows on a daily basis due to the creation of new events and ways to entice the public to try to win big bucks.
Other special event coverages
Outside of the prize indemnity field, special event coverages are more standardized. The template for the general liability and related coverages is much more defined than is the indemnification of a winning bottle cap promotion or a promotion involving six inches of rain on the Fourth of July parade. The size of the attendance at the event, type of entertainment, security measures, and theme of the event, along with other factors, will impact pricing and underwriting concerns.
Other considerations are: What medical facilities are available? Is the seating permanent or temporary bleachers? Are animals part of the event? What procedure has been put in place to monitor certificates of insurance--not only the ones required by vendors, but are you assuming more than intended liability by placing an additional insured on the primary policy?
General liability pricing for the event starts at a minimum of $250 and goes up. Pay particular attention to the policy wording in regard to exclusions and who is insured because some products are ISO policies that will not address this exposure adequately. In some situations you may need to buy back excluded coverages. If the client has more than one event per policy year, you may schedule each one and thus eliminate charging a minimum premium--providing the total doesn't exceed the company's price structure. Also be aware that for the most part premiums are fully earned on event policies because the time frame coverage that is in place is relatively short.
Prize indemnification will be more involved depending on the value of the payout and odds of winning. The cost to Winston to obtain the $1 million coverage that Jeff Gordon recently won was far less than putting the money up front, and the public relations return was money well-invested. The pricing will be as low as $250 for the "cookie cutter" risks and can exceed six figures on more elaborate promotions. Read the contract in depth to understand the provisions and have the client do the same. This segment of our industry has received some adverse publicity due to agents' failure to do those two things.
These are products that open doors to clients, provide some excitement to prospecting and increase the bottom line.
