FORM AND ENDORSEMENT CHANGES

COUNTRYWIDE

Commercial Automobile I

ISO has introduced the following forms:

CA 23 37 01 02 - War, Military Action And Terrorism Exclusion

CA 23 38 01 02 - War, Military Action And Terrorism Exclusion - Garage Coverage Form

CA 26 14 01 02 - Amendment Of Single Interest Policy Provisions - War, Military Action And Terrorism Exclusion

These forms replace the policy's previous war exclusion language to create, essentially, an absolute exclusion against damage that is caused by military or terrorist actions. There is also a newly defined term, "terrorism."

Commercial Automobile II

ISO has introduced a multi-state revision consisting of the introduction of Form CA 20 78 09 02, Physical Damage Coverage - Autos Held For Sale by Non-Dealers and revisions to the following forms:

CA 99 10 10 01 - Drive Other Car Coverage - Broadened Coverage For Named Individuals

CA 99 48 10 01 - Pollution Liability - Broadened Coverage For Covered Autos - Business Auto, Motor Carrier, And Truckers Coverage Forms

CA 99 55 10 01 - Pollution Liability - Broadened Coverage For Covered Autos - Garage Coverage Form

The DOC form was created to provide physical damage protection for cars held and sold by businesses that are covered by a CGL, but which don't have a constant auto exposure that justifies a business auto policy. The other forms contain editorial changes that, per ISO, clarify their coverage intent.

Crime And Fidelity

ISO has introduced a multi-state revision of its Crime and Fidelity Program. The changes follow a major revision that took effect in 2000. The highlight of the changes is their providing protection against an increasingly prevalent exposure, Kidnap/Ransom and Extortion. This coverage will be made available as part of a CPP or as a stand-alone (monoline) policy. Several coverage-specific exclusions apply, including barring of coverage for acts committed by insureds, losses involving military or political activity, indirect loss due to being detained from travels and loss connected to certain circumstances of surrendered property. Other program changes feature the following:

* Introduction of additional computer-related coverage, specifically for loss to electronically stored data including such data stolen by employees as well as a form for extending insured status to certain computer contractors

* Addition of new definitions and policy conditions to be used with kidnap/ransom coverage

* Revisions to most of the basic coverage forms, including switching coverage for Funds Transfer Fraud from an endorsement (CR 04 02) to an insuring agreement as well as a variety of changes to several exclusions, conditions and definitions

* Withdrawal of endorsements CR 04 02, Funds Transfer Fraud and CR 25 05, Include Leased Workers As Employees

* Extension of the program's forgery coverage to apply to electronic signatures (for specified documents)

A variety of other changes, many editorial to clarify coverage and the forms, will all carry a 07-02 edition date.

What follows is a list of individual states and which of the above changes each has approved involving ISO forms and programs. The text will not be repeated but will refer back to this Countrywide section.

Changes Made by Individual States
ALABAMA

Commercial Property--ISO's multi-state filing introducing revisions related to the handling of electronic data, commerce transacted in cyberspace, mold and other items has been approved. The forms are available for use by all participating insurers for all policies written on or after October 1, 2002.

Crime and Fidelity--The program changes referred to in the Countrywide section have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

Dwelling Liability--Form DL 98 17 04 02, Personal Umbrella Liability Policy Exclusion - Fungi, Wet or Dry Rot, or Bacteria Coverage has been approved for use by interested insurers. The form is an optional endorsement that excludes BI or PD arising out of exposure to mold. An insurer interested in using the form must make an individual filing. The form has a distribution date of August 2002.

Farm--The ISO multi-state filing introducing Form FB 10 31 07 02, War Or Terrorism Exclusion Endorsement has been approved for use by all participating insurers for all policies written on or after August 1, 2002. The form excludes coverage for loss directly or indirectly related to military or terrorist acts.

ALASKA

Businessowners--ISO's multi-state forms filing introducing several revisions, along with the following forms, has been approved for use by all participating insurers for all policies written on or after October 1, 2002:

ARKANSAS

Commercial Liability Umbrella, General Liability--ISO's multi-state introduction of optional fungi or bacteria endorsements and the commercial liability umbrella program has been approved. The General Liability changes are available for use by all participating insurers for all policies written on or after September 1, 2002. The Commercial Umbrella changes are available for use by interested insurers, and the forms will carry a September 2002, distribution date.

CALIFORNIA

Commercial Auto II--The program changes referred to in the Countrywide section have been approved, with an exception. Form CA 20 78, Physical Damage Coverage - Auto Held For Sale By Non-Dealers will be filed separately in the future. The forms were made available for use by interested insurers effective May 16, 2002.

Commercial Lines--Forms IL 03 07 02, California Changes - Actual Cash Value and IL 02 70 07 02, California Changes - Cancellation And Nonrenewal have been approved. The forms add a reference to the Capital Assets Program Coverage Part.

NOTE: ISO's new Capital Assets Program filing is STILL PENDING, but the department of insurance does not anticipate the program forms having a significant rate impact. Those insurers wishing to use the state-specific forms must file information on their impact on rates. The forms will carry an 08-02 distribution date. Crime and Fidelity--The program changes referred to in the Countrywide section, along with state-specific Form CR 02 49 07 02, California Changes have been approved. The forms are available for use by interested insurers with a distribution date of 09-02. Many of the forms will require individual insurers to file information on their impact on rates.

Homeowners--Form HO 01 04 09 02, Special Provisions - California, has been approved. The form was revised due to passage of a law that prohibits the nonrenewing of a policy while a claim is pending (exception made for earthquake losses), or when the sole reason is the insured's age.

Those insurers wishing to use the state-specific form must file information on its impact on rates. The forms were made available for use by interested insurers effective May 16, 2002.

COLORADO

Crime and Fidelity--The program changes referred to in the Countrywide section and Form CR 02 15 07 02, Colorado Changes, have been approved. The forms are available to interested insurers that must establish their own effective date. The forms have a distribution date of September 2002.

Farm--The ISO multi-state filing introducing Form FB 10 31 07 02, War Or Terrorism Exclusion Endorsement has been approved. The form is available to interested insurers who must establish their own effective date. The form has a distribution date of September 2002, and it excludes coverage for loss directly or indirectly related to military or terrorist acts.

Personal Auto--Form PP 06 61 10 02, Amendment of Policy Provision - Colorado has been approved. The form is available to interested insurers that must establish their own effective date. The form, which has a distribution date of October 2002, was revised to comply with former H.B. 1005. This law bars an insurer from canceling a policy when an insured's driver's license has been suspended related to a child support order.

CONNECTICUT

Crime and Fidelity--The program changes referred to in the Countrywide section and state Forms CR 01 41 07 02, Connecticut Changes - Legal Action Against Us and CR 02 29 07 02, Connecticut Changes have been approved. The forms are available for use by all participating insurers for all policies written on or after November 1, 2002.

Personal Auto--Form PP 03 60 09 02, Safe Driver Insurance Plan - Connecticut has been approved. The form is available for all interested insurers for all policies written on or after September 1, 2002. The form was revised to add back a reference to "Basic and Added Reparations Benefits."

DELAWARE

Commercial Property--ISO's multi-state filing introducing revisions related to the handling of electronic data, commerce transacted in cyberspace, mold and other items has been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

Crime and Fidelity--The program changes referred to in the Countrywide section have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

DISTRICT OF COLUMBIA

Commercial Auto II--The program changes referred to in the Countrywide section have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

Commercial Liability Umbrella, General Liability--ISO's multi-state introduction of optional fungi or bacteria endorsements, and the commercial liability umbrella program have been approved for use by all participating insurers for all policies written on or after October 1, 2002.

Crime and Fidelity--The program changes referred to in the Countrywide section have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

Dwelling Liability--Forms DL 24 71 04 02, Limited Fungi, Wet or Dry Rot, or Bacteria Coverage, and DL 25 08 05 02, Special Provisions - District of Columbia have been approved. The forms are available for use by all participating insurers for all policies written on or after November 1, 2002. DL 24 71 is an optional endorsement that provides limited liability coverage, on an aggregate basis, for loss related to mold, rot or bacteria. DL 25 08 alters a provision of the Dwelling Liability policy to accommodate the attachment of the DL 24 71.

FLORIDA

Commercial Auto--Forms CA 22 10 10 02, Florida Personal Injury Protection and CA 22 50 10 02, Florida Extended Personal Injury Protection have been approved. The forms are available for use by all participating insurers for all policies written on or after October 1, 2002. The forms were revised to comply with state law, particularly with the insured's waiting period before being able to begin legal action against an insurer.

Crime and Fidelity--The program changes referred to in the Countrywide section and state Form CR 01 51 07 02, Florida Changes - Legal Action Against have been approved. The forms are available for use by all participating insurers for all policies written on or after November 1, 2002.

GEORGIA

Crime and Fidelity--The program changes referred to in the Countrywide section have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

GUAM

Commercial Property--ISO's multi-state filing introducing revisions related to the handling of electronic data, commerce transacted in cyberspace, mold and other items has been approved. The forms are available for use by all interested insurers and will carry a distribution date of September 2002.

Crime and Fidelity--The program changes referred to in the Countrywide section have been approved. The forms are available to interested insurers that must establish their own effective date. They have a distribution date of September 2002.

IDAHO

Crime and Fidelity--The program changes referred to in the Countrywide section and state Form CR 01 12 07 02, Idaho Changes have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

Farm--The ISO multi-state filing introducing Form FB 10 31 07 02, War Or Terrorism Exclusion Endorsement has been approved for use by all participating insurers. The form excludes coverage for loss directly or indirectly related to military or terrorist acts. It is effective for all policies written on or after September 1, 2002.

ILLINOIS

Commercial Auto--Forms CA 01 04 09 02, Illinois Changes - Garage Coverage Form and CA 01 20 09 02, Illinois Changes have been approved. The forms are available for use by all participating insurers for all policies written on or after November 1, 2002. The forms were changed in response to a recent State Supreme Court decision (State Farm v. Smith). The forms' exception to "Who Is An Insured" that excluded entities in the automobile business as covered persons was deleted.

Commercial Auto I--The program changes referred to in the Countrywide section have been reviewed by the insurance department. The department is open to considering requests from insurers to adopt the changes. Interested insurers will be required to file proof that their financial status would be negatively impacted unless the changes are approved.

INDIANA

Crime and Fidelity--The program changes referred to in the Countrywide section and state Form CR 02 36 07 02, Indiana Changes have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

IOWA

Businessowners--ISO's multi-state forms filing introducing the following forms has been approved for use:

MAINE

Businessowners--Form BP 01 48 10 02, Maine Changes has been approved for use by all participating insurers for all policies written on or after October 1, 2002. The form was changed to comply with an insurance department request to add a definition of Actual Cash Value to the policy's Loss Payment condition.

Commercial Lines--The interline forms revised by ISO in order to accommodate their multi-state filings introducing ISO's new Capital Assets Program and Farm Umbrella Programs have been approved for use by all participating insurers for all policies written on or after September 1, 2002. Commercial Liability Umbrella, General Liability--ISO's multi-state introduction of optional fungi or bacteria endorsements and the commercial liability umbrella program has been approved for use by all participating insurers for all policies written on or after September 1, 2002.

Crime and Fidelity--The program changes referred to in the Countrywide section have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

MICHIGAN

Crime and Fidelity--The program changes referred to in the Countrywide section and state Forms CR 01 10 07 02, Michigan Changes - Duties and CR 02 46 07 02, Michigan Changes have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

Farm--The ISO multi-state filing introducing Form FB 10 31 07 02, War Or Terrorism Exclusion Endorsement has been approved for use by all participating insurers for all policies written on or after August 1, 2002. The form excludes coverage for loss directly or indirectly related to military or terrorist acts.

MISSISSIPPI

Commercial Auto--The changes to the following forms have been approved:

The forms are available for use by all participating insurers for all policies written on or after September 1, 2002. The forms were changed in response to a law that took effect in July 2002. Insureds must now, under certain circumstances, be allowed an option to purchase a single limit of nonstacking UM coverage that applies to 10 or more vehicles.

Commercial Auto II--The program changes referred to in the Countrywide section have been approved. The forms are available for use by all participating insurers for all policies written on or after October 1, 2002.

Dwelling Liability and Homeowners--The following forms have been approved:

The forms are available for use; however, interested insurers must make a separate filing, justifying the need for excluding these hazards from DP, DL and HO policies.

MISSOURI

Crime and Fidelity--The program changes referred to in the Countrywide section have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

Dwelling Liability--Form DL 98 50 11 02, Personal Umbrella Liability Policy Amendment Of Policy Provisions - Missouri. The form is available for use. Since ISO does not file this program (because of the dominance of independent programs), individual insurers interested in the form must make their own filing. The form has a distribution date of November 2002.

Dwelling Liability Dwelling Property and Homeowners--The following forms have been made available for use:

* DL 24 08 01 02 Exclusion of Terrorism (With Limited Exception) and Exclusion of War

* DP 05 35 01 02 Exclusion of War And Terrorism

* HO 05 16 01 02 Exclusion of Terrorism (With Limited Exception) and Exclusion of War

Interested insurers must make a separate filing, justifying the need for excluding these hazards from DP, DL and HO policies.

MONTANA

Commercial Auto II--The program changes referred to in the Countrywide section have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

Crime and Fidelity--The program changes referred to in the Countrywide section and state Form CR 02 18 07 02, Montana Changes have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

NEBRASKA

Crime and Fidelity--The program changes referred to in the Countrywide section and state Forms CR 01 43 07 02, Nebraska Changes - Other Insurance and CR 02 28 07 02, Nebraska Changes have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

NEVADA

Crime and Fidelity--The program changes referred to in the Countrywide section and state Form CR 02 25 07 02, Nevada Changes have been approved. The forms are available for use by all participating insurers for all policies written on or after September 1, 2002.

Farm--The ISO multi-state filing introducing Form FB 10 31 07 02, War Or Terrorism Exclusion Endorsement has been approved for use by all participating insurers. The form excludes coverage for loss directly or indirectly related to military or terrorist acts. It is effective for all policies written on or after September 1, 2002.

NEW HAMPSHIRE

NEW MEXICO

NEW YORK

The forms are available for use by all participating insurers for all policies written on or after July 1, 2002. The forms were revised to meet the requirements of Regulation 68-A.

The form was revised to comply with N.Y. INS. LAW 3425 (m) and with insurance department concerns about proper conformance with the law. The form's approach to an insurer's right to nonrenew has been clarified and approved per above.

NORTH CAROLINA

OHIO

Commercial Auto--Form PA 02 09 02, Ohio Changes - Cancellation and Nonrenewal has been approved. The form is available for use by all participating insurers for all policies written on or after September 1, 2002. The form was revised so that the termination provisions made the proper references to private passenger vehicles that met the criteria for coverage under a commercial auto policy.

The form was changed to replace two earlier editions. This single form may be attached to all commercial coverage parts, including the new Capital Assets and Farm Umbrella coverage parts.

The form was revised to introduce wording to exclude the payment of diminished value for physical damage losses. The wording was added to this amendatory form in order to preserve its standing as the state's standard readable form.

WASHINGTON

Commercial Auto--Form CA 22 57 10 02, Washington Personal Injury Protection - Named Individuals has been approved for use by all participating insurers for all policies written on or after October 1, 2002. The form was revised to comply with an insurance department request to change the form's reference to funeral expenses.

Homeowners--Form HO 01 47 08 02, Special Provisions - West Virginia has been approved. The form is available for use by all participating insurers for all policies written on or after November 1, 2002. The amendatory form was changed to comply with West Virginia cancellation statute. The form's reference to a five-day cancel notice when an arson loss occurs was deleted since it is not permitted by the law.

Personal Auto--Form PP 04 53 09 02, Uninsured/Underinsured Motorists Coverage - West Virginia has been approved. The form is available for use by all participating insurers for all policies written on or after September 1, 2002.

The form was changed in response to the decision reached in Dairyland Ins. Co. v. Fox in which the court upheld a company's assertion that UM/UIM limits within the same policy were not subject to stacking.

WYOMING

Commercial Auto--Form CA 21 23 10 02, Wyoming Uninsured Motorists Coverage has been approved. The form is available for use by all participating insurers for all policies written on or after November 1, 2002. The form was changed in response to the decision reached in Aaron v. State Farm Mutual Automobile Insurance Company. Under the revision, UIM coverage is restated so it is understood that, subject to the "Two or More Auto Policies" condition, stacking of limits is permitted. Under the Other Insurance condition, interpolicy stacking is constrained by the limits found in the first priority policy and a four-year time limit has been added.
