Overall, the EPLI market is in a level pricing mode with fewer markets, more selective underwriting, and markets unwilling to "give" away enhancements.

Although EPLI is generally thought of in terms of limited liability companies and corporations, a sole proprietor can be a candidate as well. Overall, the EPLI market is in a level pricing mode with fewer markets, more selective underwriting, and markets unwilling to "give" away enhancements.

Rich Robin, executive vice president at NAS Insurance Services, states that throughout the 1990s EPLI was considered the sexiest coverage, creating the greatest opportunity for new premium. As a universal exposure, EPLI applied to any employer. On the other hand, all who were in the market through that period learned that EPLI was--and it still is--a volatile coverage with high frequency and severity of claims.

By the beginning of 2002, according to Robin, rate increases became standard and well understood. Most carriers tightened their wording to give them more control in handling claims, including adding full or partial hammer clauses and eliminating the ability for insureds to select defense counsel. The number of available markets decreased significantly during this period.

Robin says that the current marketplace has seen very few new entrants. Markets that are presently underwriting coverage are the same ones that weathered the soft market. EPLI underwriters have tinkered with rate, form and distribution in order to better focus on underwriting profit.

"Two years of across-the-board, double-digit increases are now over, and those of us still in the market are competing for risks that mutual experience says are profitable," says Robin. "There is still competition for certain classes; however, every market has had different loss experience, so preferred classes and methods of distribution are still market-specific. Competition is smarter than in the past; markets are still under pressure to produce underwriting profit along with premium growth. Pricing is flat for good risks and moderate increases in rate and retention for high exposure classes, such as attorneys and auto dealers, are still attainable."

Some classes remain difficult, including almost any kind of dealership (auto, motorcycle or boat), collection agencies, temporary agencies, PEOs, governmental agencies, and general contractors. That being said, many can find a home--for a price.

Douglas Tobin of Five Star Managers observes that in the small market (under 1,000 employees), monoline EPLI rates have begun to level in comparison to 2003 rates, which were often up 20% to 30%. Preferred classes such as manufacturers, the hospitality industry and contractors tend to be up 0% to 15%. The tough classes--auto dealers, law firms, and property managers, or accounts with adverse loss history or layoffs/downsizing--continue to see increases of 20% to 30% or higher. "Many of these accounts tend to choose higher deductibles to offset increases. EPLI is intended to be a catastrophic loss vehicle. A $50,000 claim will not put a company out of business; however, a $500,000 uninsured loss to a small company may very well force them out of business or, at a minimum, seriously impact their profitability and future growth plans," says Tobin.

He goes on to point out that the question for 2004 and into 2005 remains: Will small market EPLI carriers return to the soft market rates of the late '90s/2001, or will they hold their rates in order to maintain long-term growth of this industry segment?

"In a quick interview with a half a dozen underwriters, the consensus is that the market in general is stabilizing," says David Smith, ARM, and vice president of casualty at International Placement Services.

Smith says it is relevant to mention that the size of account impacts the pricing and availability of higher limits. Accounts over 5,000 employees are still seeing premium increases and diminished capacity in comparison to previous years. The markets that are still putting up significant limits are AIG, Chubb, St. Paul Travelers, and Zurich. Generally the capacity for each carrier is $25 million.

"Middle market accounts are generally seeing flat to maybe 10% renewals and can normally buy whatever limits they choose," says Smith. "The market for smaller accounts has become really quite competitive in terms of pricing. Underwriters are pricing accounts 30% to 50% lower than the scheduled rates. Of course capacity is not an issue," he points out.

Coverage still varies in terms of design from one carrier to the next and remains the key issue, second only to premium. Brokers should pay particular attention to these coverage differences when counseling their clients, cautions Smith.
