You probably are unaware that you were not a winner in a Long John Silver's "Mars" promotion. No entry was necessary to win, and the rules of the promotion were simple: If NASA discovered conclusive evidence that an ocean exists or had existed on Mars and made an official declaration of that event before February 29, 2004, customers of participating Long John Silver's throughout the United States would receive free Giant Shrimp meals on Monday, March 15, 2004, from 2:00 until 5:00 p.m. SCA Promotions would cover the cost of the free meals.

Well--on March 24, USA Today reported that evidence indicated that there could have been salt water on Mars in years past. Long John Silver's got the publicity and SCA was not out thousands of Giant Shrimp meals--but it was close.

This is just one of the many kinds of promotions that can bring attention to the client. Some are designed to increase traffic in stores or trade shows. Let your imagination run wild.

"If you are meeting with a promotion planner, you know that if objectives have been met, the next measure of success is determining if the promotion comes in on budget," says Duncan McCready of IC Group, Inc., Winnipeg, Canada.

McCready says that protecting the budget means protecting against too many winners or more prize claims than could have been expected. Choices that a promotion marketer can make are: 1) manage the financial responsibility within the marketer's organization, 2) bear the complete risk of higher-than-expected prize redemptions, or 3) transfer the financial liability to a third party so that if prize redemptions are beyond expectations, the budget is protected.

Third-party organizations typically can choose between two approaches to transferring liability: insurance policies or contracts with indemnification clauses. McCready says the key differences between those types of liability transfer solutions are significant.

Presiding Law: Insurance policies are regulated by long-established, consumer protective insurance law; contracts are governed by jurisdiction and normal tort laws, says McCready.

Stability/Security: Insurance policies are rated by independent financial rating agencies (e.g., Standard & Poor's, Moody's), and constant and thorough reporting is required, as is constant updating to ensure buyer protection. No assurances are offered except the balance sheet of the company under contract, unless specified reserves are pledged and thoroughly covered in a legal contract. Company stability can't be determined without access to balance sheets on an audited, near real-time basis.

Recourse: Presiding law offers extensive precedent in the field of insurance law. State and territory regulators provide buyer support, subject to jurisdictional law and judge or jury trial outcome.

Intermediary: Licensed intermediaries, or brokers must facilitate insurance. These brokers have security requirements and are subject to insurance companies through reviews. In the event of default, the intermediary offers another line of recovery.

"If a marketer chooses to transfer financial liability to a third party, they should always be cautious of the quality of coverage they are receiving. When comparing insurance to a fixed fee contract, the marketer must understand what they are getting with each and ensure they are comparing apples to apples," cautions McCready.

"The entertainment industry is still the most frequent purchaser of weather insurance, since fair, festival and concert organizers/promoters have a limited opportunity for their events and need protection against the most uncontrollable aspect, the weather. In addition to this, any business or business owner can use this type of insurance as a promotional vehicle by offering any consumer who purchases their product within a certain promotional period a full refund in the event that a certain amount of snow or rain, for example, falls on a predesignated insured date. Given the infinite number of applications for the coverage that weather insurance can provide to contain costs, stabilize income and increase sales, the sky is the limit," says Wilson.

Whether an event is held at a temporary or permanent site, today's environment requires an emphasis on the possibility of terrorism. For example, how can you assist in the preparation for an efficient evacuation of a facility in the event of an attack? One possibility is the posting of evacuation maps.

Gerry Geare of Santa Barbara, California-based Safety Map LLC says, "Our maps add an increased level of safety to our clients and can reduce the chances of injury in an emergency situation."

Geare also expresses the belief that the industry could benefit by encouraging clients to improve and update their evacuation plans by making mapping a priority. Safety Map also archives its clients' evacuation files so that if changes are made to a venue, the existing maps can be updated to the current route of departure. (Note: OSHA requires that an Emergency Action Plan must contain evacuation maps.) Safety Map also produces "Glow Maps," which are coated with photo illuminant paint that will stay visible for up to six hours in the event of a power failure.
